Law Reviews And Affirmative Action
Orin Kerrn writing at the Volokh Conspiracy yesterday, asks
I would have thought the answer was “no,” but Josh Blackman has a very interesting post suggesting that may not be the case at least for some prominent journals.
It would never occur to me that a modern law review editor wouldn't engage in affirmative action, including trying to get more "LGBTQA" writers as well as non-Asian minorities.
In fact, it's not even clear to me that it's even illegal under the Lunch Counter Law (the Civil RIghts Act, I mean) because of the First Amendment.
